By downloading MyLoan, you concur to the following conditions:

"By downloading MyLoan, I agree to the collecting and processing of my personal data for legitimate business purposes, such as calculating my credit score and giving a loan. I hereby certify that all of the information I have supplied is truthful and correct to the best of my knowledge, and that any misrepresentations or falsifications would be deemed an attempt to deceive MyLoan and its partners. I give MyLoan permission to check and investigate the aforementioned statements/information using the references and other reasonable sources as needed. For this purpose, I hereby waive my rights on the confidentiality of client information and expressly consent to the processing of any personal information and records relating to me that might be obtained from third parties, including government agencies, my employer, credit bureaus, business associates and other entities you may deem proper and sufficient in the conduct of my business, sensitive or otherwise, for the purpose of determining my eligibility for a loan which I am applying for. Furthermore, I acknowledge that whether or not MyLoan determines my credit score or approves the loan, this application, all supporting documents, and any additional information obtained in relation to this application will be used, shared with, and remain MyLoan property. I hereby give MyLoan my express and unrestricted permission to share any information about me with any bank, affiliate, or other financial institution. I specifically acknowledge and consent to: 1) the routine submission and disclosure of my basic credit information, as well as any updates or corrections thereto; and 2) the sharing of my basic credit information with other lenders and duly authorized credit reporting agencies.”

 


Section 1. Scope of Policy and Terms
This policy applies to your use of:

1. After you have downloaded or streamed a copy of the App onto your mobile phone or portable device, visit our website or the Google Play Store ("App Site") to download or stream another copy of the MyLoan mobile application software (Device).

2. Any services offered by the App on the App Site or another one of our sites ("Services Sites").

The terms used in this policy shall have the meanings set forth below:

The term "Authorities" refers to any government, Tax Authority, securities or futures exchange, court, central bank, or law enforcement organization that has jurisdiction over MyLoan, as well as any of their agents.

"Compliance Requirements" refers to MyLoan's obligations to comply with: (a) laws, international guidance, and internal rules and processes; (b) any demand from authorities or reporting, disclosure, or other legal obligations; and (c) laws requiring us to verify our clients' identities.

Any individual inside the Territory to whom MyLoan supplies its products or services is referred to as a "Customer" or "User."

"Customer Information" includes pertinent information about you, your transactions, your usage of our products and services, and your relationships with MyLoan, as well as your Personal Data, confidential information, and/or Tax Information.

Money laundering, terrorist financing, bribery, corruption, tax evasion, fraud, evasion of economic or trade sanctions, and/or any acts or efforts to bypass or violate any laws relating to these topics are all examples of "financial crime."

“Laws” include any local or foreign law, regulation, judgment or court order, voluntary code, sanctions regime, an agreement between any member of MyLoan and an Authority, or agreement or treaty between Authorities and applicable to MyLoan.

“Personal Data” or “Personal Information” refers to any information whether recorded in a material form or not, from which the identity of an individual is apparent or can be reasonably and directly ascertained by the entity holding the information, or when put together with other information would directly and certainly identify an individual.

“Sensitive Personal Information” refers to Personal Information (1)about a person's race, ethnic origin, marital status, age, color, and religious, philosophical, or political affiliations; (2) about a person's health, education, genetic, or sexual life, or to any proceeding for any offense committed or alleged to have been committed by such person, the disposition of such proceedings, or the sentence of any court in such proceedings;(3) issued by government agencies peculiar to an individual which includes, but not limited to, social security numbers, previous or current health records, licenses or its denials, suspension or revocation, and tax returns; and (4) specifically established by an executive order or an act of Congress to be kept classified.

“Services” includes maintaining the App available on our site OR hosted on the App Site, once you have downloaded or streamed a copy of the App onto your Device.

“Tax Authorities” means Kenyan or foreign tax, revenue or monetary authorities.

“Tax Information” means documentation or information about your tax status.

“We”, “Our” and “Us” refer to MyLoan.

Reference to the singular includes the plural (and vice versa).

Section 2. Information We Collect
We might gather, employ, and distribute customer information. Customer Information may be requested from you directly, from a third party acting on your behalf, from other sources (including publicly available information), or it may be generated or combined with other data that is available to us or any member of MyLoan. Customer Information may be requested by us, on our behalf or that of MyLoan.

We may collect the following information about you, which may include non-public Personal Information:

1. Information you submit to us:

via filling out forms in the app or on the app's website;

supplied by communicating with us (e.g., via e-mail or chat);

provided by registering to use the App Site, downloading or registering an App, subscribing to any of our Services (such as applying for a loan), searching for an App or Service, sharing data via the social media functions of an App, entering a competition, promotion, or survey, and reporting a problem with an App, our Services, or any of Our Sites; and

including your name, address, e-mail address, and phone number, the Device's phone number, SIM card, age, username, password, and other registration information, financial and credit information, personal description, and photograph, as well as the Device's phone number, SIM card, age, username, password, and other registration information.

2. Information we collect about you and your device. Each time you visit one of Our Sites or use one of our Apps the information we may collect includes but is not limited to the following:

technical information, including the type of mobile device you use, unique device identifiers (for example, your Device's IMEI or serial number), information about the SIM card used by the Device, mobile network information, your device operating system, the type of browser you use, or your Device's location and time zone setting (Device Information);

information stored on your Device, including contact lists, call logs, SMS logs, contact lists from other social media accounts, photos, videos or other digital content (Content Information);

details of your use of any of our Apps or your visits to any of Our Sites including, but not limited to, traffic data, location data, weblogs and other communication data.

2.1 COLLECTION OF SMS
our app collects and monitors your SMS information so as to enrich your financial profile and assist us in performing a credit risk assessment to identify your risk profile and providing you with the proper credit analysis and ensure that users meet their credit needs. In addition, this helps us to make sure that your loan application is safe and it is you that get the loan amount. Therefore, before you submit your application, we need your authorization to collect "SMS" Information, and upload them to "https://www.myloancm.com/". We are committed to using secure data transfer protocol to encrypt data and ensure the security of information. Please feel free to use. If you do not agree, we will not perform this operation, and the application will not be able to provide normal service for you and exit Application.

2.2 COLLECTION OF CALL LOG
Our app need to obtain your call records, including phone number, name and call time, in order to verify that you are using in a normal environment, not a simulator so as to ensure account security and prevent fraud.
Therefore, before you submit your application, we need your authorization to collect "CALL LOG" Information, and upload them to "https://www.myloancm.com/". We are committed to using secure data transfer protocol to encrypt data and ensure the security of information. Please feel free to use. If you do not agree, we will not perform this operation, and the application will not be able to provide normal service for you and exit Application.

2.3 CALENDAR INFORMATION
We require calendar information so that you can set up a loan due date memo in the app after the loan, which will remind you to repay your loan on time.
The calendar information will be uploaded to https://www.myloancm.com/. We will delete the calendar information after we have determined your risk profile.

2.4 COLLECTION OF PHONE NUMBER
In order to uniquely identify you, we collect your phone number, email address and Social Account when you sign in. This helps us ensure that no unauthorized device or person is acting on your behalf.
The phone number, email address and Social Account will be uploaded to https://www.myloancm.com/.

2.5 DATA UPLOAD
To better understand your identity and ensure that your users meet their credit needs. Therefore, before you submit your application, we need your authorization to collect "Contact" , "SMS", "Calendar" and "Phone number" Information, and upload them to "https://myloancm.com/". We are committed to using secure data transfer protocol to encrypt data and ensure the security of information. Please feel free to use. If you do not agree, we will not perform this operation, and the application will not be able to provide normal service for you and exit Application.

2.6 INSTALLED APPLICATIONS
We collect each installed applications metadata information which includes the application name, package name, installed time, updated time, version name and version code of each installed application on your device to assess your credit worthiness and provide you with pre-approved customized loan offers.

3. Location information. We may also use GPS technology or other location services to determine your current location.

4. Information we receive from other sources. We reserve the right to work with a limited number of third parties (including credit reference agencies, mobile network providers, and collection agencies) and may receive information about you from them.

5. Unique application numbers. When you install or uninstall a Service containing a unique application number or when such a Service searches for automatic updates, that number and information about your installation, for example, the type of operating system, may be sent to us.

We may occasionally send you push notifications through our mobile applications with marketing messages and other transaction- or service-related alerts that may be of interest to you. By turning them off in the settings of your device or the mobile application, you can choose not to receive these kinds of communications at any time.

You may be distinguished from other users of the App, App Site, or Service Site using mobile tracking technologies and/or website cookies used by us and our third-party service providers, such as our marketing partners and analytics providers. This enables us to make the App and Our Sites better while also ensuring that you have a positive experience when using it or browsing any of the sites.

We collect certain information automatically, as do most websites, and store it in log files. Your IP address, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data may all be included in this information. For reasons such as analysis, security, content development, or marketing, we may merge this automatically acquired data with other information we collect about you from time to time.

We may use the analytics tools and software in order to develop and analyze use of the Service. Analytics companies may access anonymous individual data to help us understand how the Service is used. We may link the information we store within the analytics software to any Personal Information you submit within the mobile applications.

By uninstalling the app from your Device, you can withdraw your consent from accessing your Customer Information in the future. We may keep and share stored Customer Information after the point of uninstall for as long as necessary for the fulfillment of the purposes for which Customer Information was obtained or for the establishment, exercise or defense of legal claims, or for legitimate business purposes, or as permitted by law.

Section 3. Why We Collect Information
We collect information for the following purposes, including but not limited to (“Purposes”):

1. To process your transactions;

2. To verify your identity;

3. To disburse loans and collect payments for your use of the Service;

4. To build the credit models and perform credit scoring;

5. To analyze customer behavior;

6. To allow our partners to fulfill their obligations to you;

7. To allow us to fulfill our obligations to our partners;

8. To troubleshoot problems with the Service;

9. To comply with applicable laws, regulations, and rules, such as those relating to "know-your-customer" and anti-money laundering requirements;

10. To detect and prevent fraud and other illegal uses of the Service;

11. To send you marketing notices, service updates, and promotional offers; and

12. To contact you by telephone using auto-dialed or pre-recorded message calls or text (SMS) messages (if applicable) as authorized for the purposes described in this Privacy Policy.

Section 4. How We Use and Share Information
These clauses set forth how we will use and share your personal information. By utilizing the Services, you consent to the ways in which we and other MyLoan members may use your Customer Information. There are many uses for information.

Any category of information may be combined with any other category of information, and for as long as the combination exists, we will treat the combined information as personal data in accordance with this policy.

The information we collect will only be utilized by us for the purposes specified in this policy.

Except when necessary to provide the Services, we do not disclose to third parties any information that could be used to identify specific individuals. We might provide a small amount of personal data to a few chosen partners for analysis and development. In order to compile statistics about our user base or loan portfolio, we may give other parties anonymous personal information about our users. We may also disclose such information to any third party for such purposes, as long as the information is always anonymous.

Sharing

By using the Services, you agree that we may transmit and disclose any Customer Information to the following recipients globally (who may also process, transfer, and disclose such Customer Information for the Purposes) as necessary and appropriate for the Purposes:

every MyLoan employee, director, or officer, as well as any of MyLoan's subcontractors, agents, service providers, or associates;

payment recipients, beneficiaries, account nominees, intermediary, correspondent, and agent banks, clearing houses, clearing or settlement systems, market counterparties, upstream withholding agents, swap or trade repositories, stock exchanges, companies in which you have a security interest (where such securities are held by us for you);

any financial institutions, credit reference agencies or credit bureaus, for the purposes of obtaining or providing credit references;

any third party to whom we provide introductions or referrals;

any party in connection with any MyLoan business transfer, disposal, merger or acquisition, wherever located, including in jurisdictions which do not have data protection laws that provide the same level of protection as the jurisdiction in which the Services are supplied.

third-party service providers under contract with MyLoan that help us with our business operations, such as transaction processing, fraud prevention, and marketing. We share your Personal Information with these companies only as necessary to provide you with our Service; and

law enforcement, government officials or other third parties, but only in connection with a formal request, subpoena, court order, or similar legal procedure; or

when we believe in good faith that disclosure is necessary to comply with the law, prevent physical harm or financial loss, report suspected illegal activity, or to investigate violations of our User Agreement; or

Or any other legally permissible purpose.

Section 5. Where We Store Information
We hold the right to store and transfer the data you provide us outside of Côte d'Ivoire. People who work for us or one of our suppliers and are based outside of Côte d'Ivoire may also process your information. These employees may be working to carry out your requests. You give your consent to the data transfer, storing, and processing described above by providing your personal information. Your personal information will be kept secure and will be used in accordance with this policy to the best of our ability. We might also give your information to anyone else we think you need it to in order to give you account-related services.

Where we have given you (or where you have chosen) a password or PIN that enables you to access certain parts of Our Sites, you are responsible for keeping this password confidential. We ask you not to share a password with anyone. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to Our Sites; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.

Section 6. Customer Obligations and Rights
You agree to notify us in writing as soon as possible, and in any case within 30 days, if any changes to Customer Information provided to us or a member of MyLoan, and to reply quickly to any request from us.

Where:

you neglect to give us the customer information we reasonably requested as soon as possible, or

you refuse to give us the consents we might need to process, transfer, or disclose customer information for the purposes (aside from those related to marketing or otherwise promoting goods and services to you), or

We, or a MyLoan member, have concerns about financial crime or a risk that goes along with it.

We could:

be unable to supply new Services to you or continue to provide all or part of the Services to you, in which case we retain the right to end our agreement with you;

take actions that are necessary for us or a member of MyLoan to meet our Compliance Obligations; and/or block, transfer, or close your account(s) if local laws allow it.

We may also determine whether you are reportable to a Tax Authority based on your failure to provide your Tax Information and any accompanying statements, waivers, or consents as requested. In this case, we or other people may be required to withhold the sums that may be legally required by any Tax Authority and pay those sums to the appropriate Tax Authority.

You agree that We shall not be liable for any loss or damage arising from or incidental to our use, collection, processing and sharing of Customer Information, and any action we have taken in relation to this Section.

Federal and state laws allow you to restrict the sharing of your Personal Information in certain instances. However, these laws also state that you cannot restrict other types of sharing. Should we wish to use your information for marketing purposes, we will inform you prior to such use. You shall be entitled to prevent such usage by informing us, within 10 days of being informed of the proposed use, that you do not wish to disclose such information. You'll be informed of any upcoming changes to our privacy policy when you open the App or sign in to one of the Services Sites, as well as through this page.
